The documents that govern eleMusic, the background music service operated by eleMusic Inc. for businesses in the United States (dental practices first), and how to reach us about them.
This Legal Center is information. The documents listed in Section 1 are the governing documents, and if anything here differs from them, they control.
1. Our legal documents
- Terms of Service
- The agreement between your practice and eleMusic Inc. for using eleMusic: accounts, plans and billing, the music license, acceptable use, disclaimers, limits of liability, and how disputes are resolved.
- Privacy Policy
- What personal data we collect through the website, web player, mobile apps and sign-in (including Sign in with Google), how we use and share it, how long we keep it, and the choices and rights you have.
- Refund and Cancellation Policy
- How to cancel a location's plan, when a cancellation takes effect, and when we refund a charge. It is part of the agreement the Terms of Service describe.
- Copyright and IP Policy
- How to send us a copyright notice or counter-notice, our designated agent, our repeat infringer policy, and how our music and brand may be used.
- Subprocessors
- The service providers we use and the other third parties that receive personal data through eleMusic, what each receives, and where.
- App Store and Google Play
- If you get an eleMusic app from the App Store or Google Play, our Terms of Service, including their section on the app stores, are the license for the app. They are between you and eleMusic Inc., not Apple or Google, and Apple and its subsidiaries are third-party beneficiaries of them.
Our Contact page lists every way to reach us. If you need any of these documents in another format, email hello@elemusic.fm.
2. eleMusic at a glance
This summary is for convenience and is not part of the Terms
- Important: the Terms of Service require disputes to be resolved by BINDING INDIVIDUAL ARBITRATION, WAIVE CLASS ACTIONS AND JURY TRIALS, DISCLAIM WARRANTIES AND LIMIT OUR LIABILITY. Please read them.
- The music. Original instrumental music and nature soundscapes, generated and mastered by eleMusic. We create it with generative AI models, including models from third parties. We license it to you by contract; it is not exclusive to you, and other music that sounds similar may exist.
- What your subscription includes. Playing the eleMusic catalog as background audio inside the locations you subscribe, through the eleMusic web player or apps, while your trial or subscription is active, on up to your plan's number of devices playing at once.
- What it does not include. Music on hold or any phone system, video or social posts, broadcast, streaming, playing it anywhere other than your subscribed locations, recording, downloading, redistribution or resale.
- No PRO license, no indemnity. eleMusic is not licensed through ASCAP, BMI, SESAC, GMR or any other performing rights organization, and your subscription is not a license from one. We do not defend, indemnify or pay claims for you, and we cannot promise that no one will contact you about music licensing.
- No patient data, no BAA. eleMusic does not need and is not designed to receive patient information. Do not enter patient names or health details in practice names, room labels, track reports or emails. eleMusic is not a business associate and does not sign business associate agreements.
- Background music only. eleMusic is not a medical device, treatment or therapy, and makes no health claims.
- Who can use it. Businesses in the United States, through adults (18 or older) authorized to act for them. People aged 13 to 17 may use the player and the apps with permission (Terms, Section 3.1). We block any location whose billing address at checkout is outside the United States.
- Trial, renewal and cancelling. New locations may be eligible for one free 14-day trial. Starting it needs a card, but nothing is charged up front. Unless you cancel before the trial ends, your paid plan starts automatically when it ends, your card is charged the plan price that day (we email a reminder first), and the plan renews automatically every month or year (annual plans are charged up front), at your plan's price plus any applicable tax, until you cancel. You can cancel any time in Manage billing; cancelling stops renewal at the end of the period already paid for, and fees already paid are not refunded except as the Terms, our Refund and Cancellation Policy or the law require. If a renewal payment fails, we retry it for up to about two weeks while the music keeps playing; if it still fails, the plan is canceled and playback stops until you subscribe again (with no new trial). Payments are processed by Stripe, and eleMusic Inc. is the seller. See the Terms for billing, renewals, price changes and refunds.

3. Report a problem
3.1 A track that sounds wrong
Use Flag this track in the web player or the app. A flag normally takes the track out of rotation for every practice while we review it. Flags record your practice, the track, the time, the room label set on that player and the player's random device identifier, so please do not type patient information into room labels.
3.2 Copyright or other rights
If you believe something on eleMusic infringes your copyright or other rights, follow the steps in our Copyright and IP Policy and send your notice to our designated agent, Joshua Nelson, at hello@elemusic.fm.
3.3 A music licensing letter
If your practice receives a letter about music licensing, do not ignore it. Forward it to hello@elemusic.fm with your certificate id. We aim to reply within 2 business days with your Original Catalog Certificate, its verification link and a general information template; that is a target, not a promise. We do not respond, negotiate or speak for your practice, we do not give legal advice, and we do not pay or defend claims. Any reply is your decision; consider asking your own lawyer.
3.4 Privacy requests
To ask about, correct or delete personal data, or to make any other privacy request, email hello@elemusic.fm. Some records are kept even after a deletion request, for example billing and tax records, records of accepting our Terms and certificate history. Our Privacy Policy explains these exceptions, how we handle requests and how we verify who is asking.
3.5 Security issues
If you believe you have found a security vulnerability in eleMusic, email hello@elemusic.fm with enough detail for us to reproduce it. Please give us reasonable time to fix it before telling anyone else. Do not access, change or delete data that is not yours, do not disrupt or degrade the service, and do not test against other customers' accounts or devices. We do not offer payment for reports. This page does not authorize you to access, scan, probe or test any eleMusic system, account or device; any such activity remains subject to the Terms of Service and applicable law.
3.6 Misuse of the service
If you see an access code shared publicly, eleMusic played somewhere it should not be, or any other misuse, email hello@elemusic.fm. Practice owners can rotate their access code at any time, which signs out every device.
3.7 Legal notices and legal process
Legal notices under the Terms of Service, including notices of dispute, arbitration opt-outs and rejections of changes, may be sent by email to hello@elemusic.fm or by mail or courier to eleMusic Inc., Attn: Legal, 8 The Green, Suite B, Dover, Delaware 19901, as Section 27.4 of the Terms describes. Copyright and trademark notices and counter-notices follow our Copyright and IP Policy, and privacy requests follow our Privacy Policy. Service of process must be made on our registered agent as the law requires. Law enforcement and government requests may also be sent to hello@elemusic.fm; this does not waive any requirement for valid legal process.
4. Trademarks
eleMusic, the eleMusic logo and elemusic.fm are trademarks of eleMusic Inc. or its licensors. A customer may state accurately, in plain text (for example on a sign in its office or on its website), that it plays music from eleMusic. Otherwise, without our prior written permission, you may not use our logo, use our name in advertising, or use our marks or anything confusingly similar in a business name, domain name, product or social account, or in a way that suggests we sponsor, endorse or are affiliated with you. Never make health, medical or therapeutic claims about eleMusic or attribute such claims to us. See our Copyright and IP Policy.
Google, Chromecast, Apple, AirPlay, App Store, Google Play, Stripe and other third-party names and marks mentioned on our sites belong to their owners. Mentioning them describes how eleMusic works and does not mean those companies sponsor or endorse eleMusic.
5. Version history
Each document shows its version and effective date at the top. When we make a material change, we will post the new version here and give notice as that document describes.
- Privacy Policy version 2026-11-30 (published , effective ): describes the emails we write to practices we do not yet work with (Sections 3.10 and 15.3) and how long we keep those records (Section 10); email updates go only to people who tick an unchecked box and confirm by email, with unsubscribes honored within 2 days (Sections 3.11, 5 and 15.2); our emails carry no tracking pixels or click tracking (Section 15.4). It replaces Privacy Policy version 2026-10-13, which applies until the new version takes effect on November 30, 2026.
- Service providers page version 2026-11-30 (published , effective ): adds Mailforge and Smartlead for the emails we write to practices, and the Resend row now covers email updates to people who opted in. It replaces version 2026-10-11 of that page. The Terms of Service and the other documents keep their versions.
- Privacy Policy version 2026-10-13 (): a room device now stays signed in while it plays, and its sign-in ends after 90 to 105 days without playing (it was 30 days); Sections 3, 10 and 14 say so. Sign-ins to an account still expire after 30 days.
- Privacy Policy version 2026-10-12 (): "practice code" is now "access code" throughout, the name the player and the apps show; Sections 3.9 and 9.3 say that the Apps never ask for access to your device's location, and that on iPhone and iPad, Google's Cast software, which the App uses to play music on Chromecast and other Cast devices, may collect an approximate (coarse) location, which Google handles under its own privacy policy; and Section 1 describes eleMusic as a service for businesses in the United States, dental practices first. It replaces Privacy Policy version 2026-10-11.2. The Terms of Service, the Copyright and IP Policy and the service provider list keep their versions.
- Refund and Cancellation Policy version 2026-10-12 (): the key points and Section 6 now say "If a renewal payment fails", because the first charge after a free trial is different: if it fails, the music stops until a payment succeeds (Section 3 and Terms Section 14.10). Section 1 now names only Manage locations, the player's button. It replaces version 2026-10-03 of that policy, which was edited twice without a new version number: on October 3, 2026, when Terms version 2026-10-03.2 was published, to say that the free trial needs a card (the key points and Section 3), and on October 4, 2026, to add to Section 3 that if the first charge after the trial fails, the music stops until a payment succeeds. The Terms of Service, the Copyright and IP Policy and the service provider list keep their versions.
- Contact page version 2026-10-12 (): it asks you never to send access codes (it said practice codes), and Section 1 adds "We aim to reply within 1 business day. That is a target, not a promise." It replaces version 2026-10-03 of that page. The Terms of Service, the Copyright and IP Policy and the service provider list keep their versions.
- Service providers page version 2026-10-11 (): the Render row now names the edge network that delivers our websites and sign-in service, operated by Cloudflare, Inc., and links its privacy policy. It replaces version 2026-10-03 of that page; the Terms, Privacy Policy and other documents keep their versions.
- Terms of Service version 2026-10-11 (): people aged 13 to 17 may use the Player and the Apps, including a Room Device, with the permission of a parent or legal guardian or, for a Room Device, of the Customer that authorized them, while creating an Account, accepting the Terms and subscribing still require an adult (Section 3.1); and if the first payment after a free trial fails, playback stops until a payment succeeds (Section 14.10). It replaces Terms version 2026-10-03.2.
- Privacy Policy version 2026-10-11.2 (): Section 13 now covers people aged 13 to 17, who may use the player, the Apps or a room device with permission, and the summary near the top matches it. It replaces Privacy Policy version 2026-10-11, published earlier the same day. The other documents keep their versions.
- Privacy Policy version 2026-10-11 (): describes the status a connected room device reports while it is connected (the station and track, whether it is playing or paused, the speaker it plays to, which can include a Cast speaker's name, its volume and the app version), that we keep only the latest status for each device and delete room commands once they are more than a day old, and that a location's owners and administrators can see each room and control it (Sections 3, 3.3 and 7.2). It describes room control, part of the Service since October 6, 2026; the status it adds is shown only to that location's owners and administrators. It replaces Privacy Policy version 2026-10-03. The other documents keep their versions.
- Terms of Service version 2026-10-03.2 (): a free trial now requires a payment method and, unless canceled before it ends, converts to the paid plan when it ends (Section 14.3, the renewal notice in Section 14.4 and the key points). It replaces Terms version 2026-10-03. The other documents keep version 2026-10-03; this summary was updated to match.
- Version 2026-10-03 (): first publication of the Terms of Service, Privacy Policy, Refund and Cancellation Policy, Copyright and IP Policy, service provider list, Contact page and this Legal Center.
